Mercury Terms & Conditions (Terms of Service)

1) Who May Use Mercury

Adults. The Service is intended to be purchased and managed by a parent, legal guardian, or other adult ("Account Holder").

Children. Children may use the Service only under the supervision of the Account Holder and subject to these Terms.

Eligibility. You must be able to enter into a binding contract in your jurisdiction to create an account and purchase a subscription.

2) Privacy, Children's Privacy, Parental Controls, and COPPA Rights

Privacy Policy. Your use of the Service is also governed by our Privacy Policy: https://www.mercurytv.me/privacy

Parental Controls. Mercury may offer parental controls and profile settings (for example, age-based profiles, viewing restrictions, PIN/lock settings, or other controls depending on device/platform). The Account Holder is responsible for configuring these controls and supervising a child's use of the Service.

Children's Data and COPPA. Mercury is designed for children's and family viewing. Where the U.S. Children's Online Privacy Protection Act ("COPPA") applies, we limit collection of personal information from children and, where required, obtain verifiable parental consent.

Parental Rights. Subject to applicable law and identity verification, the Account Holder (or parent/legal guardian) may request to:

• review the personal information we have collected from a child (if any);
• direct us to delete a child's personal information; and/or
• refuse further collection or use of a child's personal information.

3) No Ads; No Behavioral Advertising

Ad-Free Viewing. The Service is intended to provide an ad-free viewing experience within Mercury.

No Behavioral Advertising. Mercury does not serve targeted or "behavioral" advertising based on a user's viewing activity within the Service.

Third-Party Platform Notices. Your device operating system, app store, browser, or third-party platforms may show content or promotions outside of Mercury's control. Those are governed by the third party's policies.

4) Service Territory

The Service is offered only in the United States. We may use technical measures to confirm or enforce this limitation. Content availability may vary by location.

5) Accounts, Profiles, and Security

Account Information. You agree to provide accurate information and keep it up to date.

Security. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.

Profiles. The Service may allow multiple profiles. The Account Holder is responsible for profile settings, restrictions, and supervision.

6) Subscriptions, Billing, Auto-Renewal, and Cancellation (Cleeng)

Subscriptions. Mercury is a subscription service. Pricing, plan details, and billing intervals are presented at checkout.

Payment Processor (Cleeng). Subscriptions and payments may be processed and managed through Cleeng (the "Billing Provider"). Your purchase may be subject to additional terms and policies of the Billing Provider, in addition to these Terms.

Auto-Renewal. Unless you cancel before the renewal date, your subscription will automatically renew and you authorize the Billing Provider (and/or its payment methods on file) to charge the applicable subscription fee plus taxes.

How to Cancel. You can cancel according to the cancellation flow provided through Cleeng (e.g., via your account portal, a cancellation link, or the method provided at purchase). Cancellation takes effect at the end of the then-current billing period unless otherwise stated at checkout.

Refunds. Payments are nonrefundable and we do not provide prorated refunds for partial subscription periods, except where required by law or expressly stated at checkout.

Plan/Price Changes. We may change subscription plans or prices from time to time. If required by law, we will provide advance notice. Changes generally apply at your next renewal unless otherwise stated.

7) Content Availability and Service Changes

Curated, Family-Focused Experience. Mercury provides curated children's and family content.

Rotation and Removal. Titles may be added or removed due to licensing, legal, or business reasons. We do not guarantee that any specific title will remain available.

Updates/Modifications. We may update or modify features, the catalog, or the Service. Some features may be device- or platform-dependent.

8) Streaming Limits and Device Access

We may limit usage to prevent abuse and ensure fair access, including limits on simultaneous streams, device registrations, or similar restrictions. Any plan-specific limits will be disclosed at checkout and/or in your account settings.

9) License to Use the Service

Subject to these Terms and an active subscription, Mercury grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial viewing within the United States.

10) Prohibited Conduct

You agree not to (and not to allow others to):

• Copy, record, reproduce, distribute, publicly perform, or display the Service or content except as expressly permitted by law or the Service;
• Share or sell your account access, or otherwise provide the Service commercially;
• Circumvent DRM, access controls, geofencing, or security measures;
• Reverse engineer, decompile, or attempt to extract source code except where prohibited by law;
• Use bots, scraping, or automated means to access the Service;
• Interfere with or disrupt the Service, including by introducing malware.

11) Intellectual Property

The Service, including software, design, branding, and interfaces, is owned by Mercury and/or its licensors and protected by law. All third-party content (shows, characters, artwork, etc.) remains owned by the respective rights holders. No rights are granted except the limited license in these Terms.

12) Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, you may submit a notice to our DMCA contact at capsule@mercurytv.me with:

• identification of the copyrighted work claimed to be infringed;
• identification of the allegedly infringing material and where it appears on the Service;
• your contact information;
• a statement that you have a good-faith belief the use is not authorized; and
• a statement made under penalty of perjury that your notice is accurate and you are authorized to act.

13) Third-Party Services

The Service may integrate with third parties (including the Billing Provider, app platforms, device manufacturers, and analytics providers). Your use of those services may be subject to their terms and privacy policies. Mercury is not responsible for third-party services outside our control.

14) Suspension and Termination

We may suspend or terminate access to the Service if:

• you violate these Terms;
• we must do so to comply with law; or
• your use poses risk or harm to Mercury, users, licensors, or others.

You may stop using the Service at any time. Termination does not eliminate payment obligations accrued prior to termination.

15) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERCURY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT ANY SPECIFIC CONTENT WILL BE AVAILABLE.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERCURY AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERCURY'S TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THAT PERIOD.

Some jurisdictions do not allow certain limitations; in that case, limitations apply to the maximum extent permitted.

17) Indemnification

You agree to indemnify and hold harmless Mercury and its affiliates, licensors, and employees from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or violation of these Terms.

18) Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.

19) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice as required by law (for example, via in-app notice or email). Continued use of the Service after the effective date of updated Terms means you accept the changes.
